1. Data Controller vs. Data Processor
For the purposes of the California Consumer Privacy Act (CCPA) and other applicable US privacy laws:
The Participating Business (Merchant) is the “Data Controller” or “Business” regarding the Participant’s information, deciding how captured leads are used for their marketing.
MIC Technologies acts solely as the “Data Processor” or “Service Provider,” operating the technology and storing the data securely on behalf of the Merchant. We do not sell your personal information.
2. Information We Collect
Participant Data: First and last name, email address, phone number, prize redemption codes, consent logs (including IP address and timestamp), and participation history.
Merchant Data: Business name, contact details, billing information, and campaign configurations.
Technical Data: Device information, IP address, browser type, and usage data.
3. How We Use Your Information
We use the collected information to manage promotional campaigns, deliver platform services, send transactional emails (e.g., prize confirmations), and ensure platform security.
4. Sharing with Participating Businesses
When a Participant enters their details into a specific Merchant’s campaign, that information is shared directly with that Merchant. Each Merchant is individually responsible for its own compliance with the CCPA, TCPA, CAN-SPAM, and other applicable laws.
5. Marketing Communications and Opt-Out (TCPA & CAN-SPAM)
By voluntarily checking the marketing consent box, Participants provide prior express written consent to receive promotional emails or SMS from the specific participating Merchant. Participants may opt out at any time by following the “unsubscribe” instructions provided in the Merchant’s communications.
6. Data Retention and Security
We retain personal information for as long as necessary to provide our services and comply with legal obligations. We implement commercially reasonable technical safeguards to protect data.
7. Your Privacy Rights (CCPA)
California residents and users in applicable jurisdictions have the right to request access to, correction of, or deletion of their personal information. Participants wishing to exercise these rights regarding marketing lists must contact the Merchant directly. For data deletion from our core infrastructure, please contact us.
8. Children’s Privacy (COPPA)
This platform is not intended for children under the age of 13, and participation requires users to be at least 18. We do not knowingly collect personal information from minors.
